Terms of sale
1. Who we are
These terms apply to every order placed at trybram.com. The seller is [name of the person or company that runs BRAM], [street and number], [postal code and town], Switzerland (“BRAM”, “we”). For anything about an order, write to support@trybram.com; for questions about these terms, write to legal@trybram.com.
We sell to consumers in Switzerland, Liechtenstein and the member states of the European Union.
2. The balm
BRAM balm is a cosmetic product made by hand in small batches from grass-fed beef tallow, extra virgin olive oil and raw honey. Colour, scent and texture can vary slightly from batch to batch.
The balm is for external use only. It contains honey, a bee product, and beef tallow. If you have allergies or sensitive skin, try it on a small area first. It is not a medicine and is not meant to treat any condition.
3. Ordering
Putting a jar in your cart is not yet an order. You place a binding order when you confirm payment at checkout. The contract is concluded when your payment is confirmed and the order confirmation is shown to you. We also send the confirmation to the email address you gave.
If we cannot fulfil an order, for example because a batch has sold out, we will tell you without delay and refund everything you paid.
4. Prices and payment
Prices are shown in Swiss francs (CHF). The shipping cost depends on the destination and the size of your order and is shown at checkout before you pay.
Payment is taken at the time of the order through our payment provider, Stripe, using the payment methods offered at checkout. If your card is in another currency, your bank sets the exchange rate and may charge a fee.
5. Delivery
We ship from Lugano with Swiss Post, normally within a few working days of your order. Delivery times depend on the destination and on the postal service of your country.
If we cannot dispatch your order within 30 days, we will tell you and you may cancel for a full refund.
Please check that your address and phone number are complete and correct: parcels that cannot be delivered are returned to us and have to be sent again at your cost.
6. Deliveries to the European Union: customs and import VAT
Your order ships from Switzerland, which is outside the EU customs territory. Each parcel is therefore subject to the import VAT of your country, to the EU customs duty for low-value consignments, and to the handling fees of the postal services involved.
Unless checkout shows these charges as prepaid for your country, they are not included in our prices: the postal service of your country collects them from you on delivery, and they are your responsibility. Where checkout shows them as prepaid, we pay them for you and nothing further is due on delivery.
If a parcel comes back to us because these charges were not paid or the parcel was not collected, we will get in touch. We can send it again once the new shipping cost is paid, or treat the return as a withdrawal under section 7.
7. Returns and right of withdrawal
You may withdraw from your purchase within 14 days of receiving it, without giving a reason. To do so, write to support@trybram.com within that time and send the unopened jar back to us within 14 days of your message. You pay the cost of sending it back.
We refund the price of the jar and the standard shipping cost you paid, using the payment method you used, within 14 days of receiving the jar or proof that you sent it.
Because the balm is a skin care product, jars that have been opened or used cannot be returned, for reasons of hygiene and health protection.
8. If something is wrong
If your jar arrives damaged, is faulty, or is not what you ordered, write to support@trybram.com as soon as you can, with a photograph if possible. We will replace it or refund you, at no cost to you.
Your statutory rights in case of defects are not affected by these terms.
9. Liability
We are liable without limit for damage caused intentionally or by gross negligence, for personal injury, and wherever the law does not allow liability to be limited, including product liability. Otherwise our liability is limited to the value of your order, as far as the law allows.
10. Applicable law
These terms are governed by Swiss law. If you are a consumer living in the EU, you also keep the protection of the mandatory consumer law of the country where you live, and you may bring a claim before the courts of that country.
If one of these terms turns out to be invalid, the others remain in force.
